Welcome to Farkle Holdings LLC (“Farkle Holdings,” “Farkle Management,” “Farkle,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of our website located at www.farklemgmt.com (the “Site”), as well as any related property management or rental services offered through it, including but not limited to long-term rentals, short-term rentals, vacation rentals, and other related offerings (collectively, the “Services”).

By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility

To access or use our Site and Services, you must:

  • Be at least 18 years of age, and

  • Have the legal capacity to enter into binding agreements under applicable law.

By using the Site, you represent and warrant that you meet these eligibility requirements.

2. Services Overview

Farkle Holdings LLC provides property listings and management services for rental properties located in Connecticut and Florida, including:

  • Long-term leases,

  • Short-term and vacation rentals, and

  • Property management and booking coordination.

All bookings are subject to approval and availability, and may be reviewed, modified, or declined at the company’s discretion.
Certain legal, tax, or compliance obligations may vary by state or municipality.

3. Booking, Payments, and Cancellations

Booking Confirmation:
All reservations are considered pending until confirmed in writing (e.g., via email or official booking notice).

Payments:
Payments may be processed through authorized third-party providers. By submitting payment information, you authorize Farkle Holdings and its payment partners to process applicable charges in accordance with your booking details.

Cancellations and Refunds:
Cancellation, modification, and refund requests are handled on a case-by-case basis at the sole discretion of Farkle Holdings LLC.
Specific policies, fees, or refund eligibility will depend on the property type, duration of stay, and circumstances surrounding the cancellation.

Unless otherwise stated in a written agreement or booking confirmation, no universal refund or cancellation policy applies.
Decisions regarding cancellations, rescheduling, or credits remain fully at the discretion of the Company, based on fairness, contractual obligations, and operational considerations.

Security Deposits:
Some properties may require a refundable security deposit, communicated prior to booking confirmation. Refunds of deposits are subject to inspection and compliance with property rules.

4. User Responsibilities

By using the Site or Services, you agree to:

  • Provide accurate, complete, and current information when submitting inquiries or making bookings.

  • Use the Site and Services only for lawful purposes.

  • Not interfere with, damage, or disrupt the Site, its systems, or its servers.

  • Not upload or transmit malware, viruses, or any harmful code.

  • Comply with all applicable laws and regulations, including those governing rental activity in the state where a property is located.

You are responsible for maintaining the confidentiality of your account and all activities under your credentials.

5. Property Use and Guest Conduct

Guests and renters must follow all property-specific rules and regulations, which are provided before occupancy. Guests are expected to:

  • Treat the property respectfully,

  • Avoid damage or misuse,

  • Follow local ordinances, community standards, and HOA policies, and

  • Observe posted occupancy limits and quiet hours.

We reserve the right to cancel or terminate any booking (with or without refund) if a guest violates any rules, damages property, engages in unlawful conduct, or causes disruption to others.

6. Intellectual Property

All content, materials, text, images, logos, graphics, and software on the Site are the property of Farkle Holdings LLC or its licensors and are protected by copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any material on this Site without prior written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Farkle Holdings LLC and its affiliates, officers, employees, and agents shall not be liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages,

  • Any loss of profits, goodwill, data, or opportunity, or

  • Any injury, accident, or property damage arising from use or occupancy of a rental property.

All content and services are provided “as is” and “as available”, without warranties of any kind, express or implied.

8. Indemnification

You agree to defend, indemnify, and hold harmless Farkle Holdings LLC, its affiliates, and representatives from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your use of the Site or Services,

  • Any breach of these Terms, or

  • Any violation of applicable laws or third-party rights.

9. Privacy

Your use of the Site is governed by our Privacy & Cookie Policy, which explains how we collect, use, and protect personal data. Please review it carefully.

10. Termination of Use

We may suspend or terminate your access to the Site or Services at any time, without notice, if we determine that your conduct violates these Terms, applicable law, or the integrity of our operations.

11. Governing Law

These Terms and any disputes arising out of or related to your use of the Site or Services shall be governed by and construed under the laws of the State of Connecticut or the State of Florida, depending on where the property or transaction originated.

  • For Connecticut-based properties or users → Connecticut law applies.

  • For Florida-based properties or users → Florida law applies.

12. Dispute Resolution and Venue

You agree to attempt to resolve any dispute informally by contacting us first.

If a resolution cannot be reached:

  • Disputes involving Connecticut-based services shall be resolved in the courts of Connecticut.

  • Disputes involving Florida-based services shall be resolved in the courts of Florida.

You consent to the exclusive jurisdiction and venue of the applicable courts listed above.

13. Compliance with Local Regulations

Guests and owners must comply with all local ordinances, zoning laws, and rental regulations relevant to the property location.

In Florida, this includes but is not limited to:

  • Vacation rental licensing and registration laws,

  • Local occupancy and noise regulations, and

  • Municipal short-term rental rules (e.g., Miami Beach, Orlando, Tampa).

Farkle Holdings reserves the right to cancel any booking or agreement without liability if fulfilling it would violate state or local law.

14. Updates to These Terms

We may update or modify these Terms from time to time. Any changes will be posted on this page with an updated “Effective Date.”

Your continued use of the Site after such updates constitutes your acceptance of the revised Terms.
